§ 1 Scope, provider
(1) These General Terms and Conditions (GTC) apply to all contracts for the use of the online service TRACER (hereinafter "TRACER" or "Service") between Elias Schulte-Einhaus, Tracer (Sole proprietorship), Annenstraße 33, 20359 Hamburg, Germany, Email: service@usetracer.app (hereinafter "we" or "us") and the users of the service (hereinafter "you").
(2) Conflicting terms from the user do not apply, even if we do not expressly object to them.
(3) A consumer within the meaning of these terms is any natural person who concludes a contract for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 BGB). An entrepreneur is any natural or legal person or legally capable partnership that, when concluding the contract, acts in the exercise of its commercial or independent professional activity (§ 14 BGB).
§ 2 TRACER services
(1) TRACER is a research tool for crypto assets, especially so-called meme coins. After entering a contract address, TRACER collects publicly available information from sources such as blockchains, trading platforms, launchpads, coin directories, social networks and web search, and presents it with the source stated. The scope of services follows the description on our website at the time the contract is concluded, in particular on the pages "Features" and "Pricing".
(2) No investment advice. TRACER provides information exclusively. TRACER does not give investment advice, investment or placement brokering, recommendations to buy, hold or sell crypto assets, or legal or tax advice. TRACER does not provide crypto-asset services within the meaning of Regulation (EU) 2023/1114 (MiCA). Decisions about buying and selling are yours alone and made at your own risk. Crypto assets, especially meme coins, are highly speculative; a total loss is possible at any time.
(3) Third-party data. The data shown comes mainly from third parties. Where possible we check it for plausibility, but we cannot guarantee its accuracy, completeness or currency. If reliable sources are missing, TRACER marks the information as unknown; the absence of a warning does not mean that no risk exists.
(4) Artificial intelligence. Parts of the content, especially the report on a coin and translations, are created with the help of an AI system (currently Claude by Anthropic, PBC). AI-generated content is identifiable as such, may contain errors and does not replace your own verification. Please check important statements against the linked sources.
(5) TRACER does not connect to your wallet, does not require private keys or seed phrases, and does not execute transactions.
(6) To provide our services, we may use third parties, such as hosting, payment, data and AI providers.
§ 3 Registration and account
(1) Using TRACER requires an account. Only persons who are at least 18 years years old and have full legal capacity may create an account.
(2) The information requested during registration must be true and complete. Each account is personal and may not be shared with other people. Keep your access data secret and notify us without delay if you suspect misuse. You are liable for use of your account by third parties only if you are responsible for the misuse.
(3) There is no entitlement to registration. Use of TRACER is not permitted for persons who are prohibited from using it under the laws applicable to them, nor for persons and organisations subject to sanctions of the European Union or the United Nations. You are responsible yourself for ensuring that use is permitted at your place of residence.
§ 4 Plans and conclusion of contract
(1) We offer a free trial ("Free") with 3 Coins once, and paid plans (currently "Trader", "Pro" and "Elite"). The paid plans differ in the number of Coins you can check per calendar month (§ 5). The current plans and prices are on the "Pricing" page.
(2) The contract for the free account is concluded when you complete the registration and confirm your email address via the link sent to you.
(3) For a paid plan, you select the plan and payment method, review your details in an overview, and can correct input errors before submitting. By clicking the button "subscribe with payment obligation", you make a binding offer. The contract is concluded when we confirm the order, but at the latest when the plan is activated. You will receive the confirmation by email together with these GTC.
(4) The contract language is German. We store the contract text; you can access and print these terms at any time on this page.
§ 5 Coins (usage quota)
(1) A "Coin" is one complete check of a contract address, consisting of the instant card, X check and report. Viewing an already created report again does not use up any additional Coin. If a report cannot be completed for technical reasons, it is not counted.
(2) The free trial gives you 3 Coins once. They are not renewed monthly. Test Coins apply per account and per internet connection: no more than 3 Test Coins in total can be used from one internet connection (IP address), even if several accounts exist. For this we store an encrypted key of the connection, not the IP address in plain text; it is deleted one year after the last test.
(3) On paid plans, the quota is available for one calendar month at a time. Unused Coins expire at the end of the month and are not carried over to the following month; they have no cash value and are not paid out. The quota resets on the first day of each calendar month. If you check the same address again within 24 hours, this does not use up any additional Coin.
(4) You can see at any time how many Coins you have used and how many are left, at the top of TRACER and in your account under "Plan & Coins". If the quota is used up, you can wait until the start of the next month or switch to a larger plan. No automatic recalculation takes place.
(5) To prevent abuse and disproportionate costs, we may set further technical limits, for example on the number of simultaneous queries or on translations. Such limits do not restrict normal use within your plan.
§ 6 Prices and payment
(1) The prices listed on the Pricing page at the time of order apply. All prices are final prices, in euros in Europe, otherwise in US dollars. The annual plan costs ten monthly prices.
(2) Paid plans are billed in advance, monthly or annually depending on the billing cycle you choose. Payment is processed by our payment service provider Stripe. Stripe acts as the seller in this process, calculates the VAT and issues your invoice. The payment methods offered are those that Stripe makes available in your country.
(3) If you fall behind on a payment, we may downgrade the paid plan to the free plan after giving prior notice, until the payment is received. Further statutory rights remain unaffected.
(4) If you switch to a larger plan, it takes effect immediately; we charge the price for the current billing period pro rata. A switch to a smaller plan or to a shorter billing cycle takes effect at the start of the next billing period.
(5) We will notify you in text form of price changes for existing contracts at least six weeks before they take effect. They apply only if you expressly agree to them. If you do not agree, your plan continues at the previous price until one of us terminates it in accordance with § 7.
§ 7 Term and termination
(1) The free account runs for an indefinite period. You can end it at any time by deleting your account.
(2) Monthly plans run for one month and renew automatically for another month each time unless they are cancelled. Annual plans run for twelve months; afterwards they renew for an indefinite period and can then be cancelled at any time with one month's notice. You can cancel at any time effective at the end of the current billing period. Your account then remains free of charge; Test Coins already used will not be granted again.
(3) You can cancel in particular via the button "Cancel contracts here" on our website, in your account under "Plan & Coins", or by email to service@usetracer.app cancel. We will confirm receipt of your cancellation by email without delay.
(4) We may terminate paid plans with one month's notice to the end of a month, and the free plan with two weeks' notice.
(5) The right of both parties to terminate for good cause remains unaffected. For us, good cause exists in particular if you seriously or repeatedly, despite a warning, violate these terms, in particular § 8, or are in arrears with payment of more than one monthly price for longer than 30 days.
(6) After the end of the contract you can still download your data for 30 days via the export function; afterwards we delete it, unless statutory retention obligations apply.
§ 8 Your obligations, prohibited use
(1) You may use TRACER only within the scope of these GTC and applicable laws. In particular, the following is prohibited:
- TRACER automated queries, for example through bots, scrapers or scripts, unless we provide an interface for this;
- systematically copy, resell or provide content from TRACER in a service of your own;
- share accounts, create multiple accounts to get around quotas, or bypass technical limits;
- endanger the security or operation of TRACER or gain access to systems;
- TRACER to engage in market manipulation, fraud or other unlawful purposes;
- when sharing content from TRACER, giving the impression that TRACER recommends a coin.
(2) We display content from X (formerly Twitter) and other services in accordance with their terms. If such content is deleted at the source, we also remove it from our side.
(3) If you violate these terms, we may temporarily suspend your account. In doing so, we take your legitimate interests into account and inform you, unless doing so would jeopardise the investigation.
§ 9 Availability and changes to the service
(1) We strive to keep TRACER available without interruption. Maintenance work, disruptions at data sources and events beyond our control may lead to restrictions. Data from sources may be delayed.
(2) We may change and further develop TRACER if there is a valid reason, for example to adapt to new technical developments, changed data sources or legal requirements, and this does not cause you any additional costs. If a change affects your access or usability more than insignificantly, we will inform you in text form in good time in advance. You can then terminate the contract free of charge within 30 days of the information or of the change, whichever is later; we will refund amounts already paid for the period after that on a pro rata basis.
(3) Third-party data sources may change or cease to exist. In that case, we will endeavour to provide equivalent replacements.
§ 10 Defects
(1) The statutory warranty rights apply; for consumers, in particular the provisions on digital products (§§ 327 et seq. BGB). We provide you with the updates required to maintain conformity of the contract.
(2) That third-party data is incorrect, delayed or incomplete is not a defect of TRACER, as long as TRACER reproduces and labels it correctly according to its source. Please report to us any errors you notice.
§ 11 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, to the extent of an assumed guarantee, and for defects fraudulently concealed.
(2) If a slightly negligent breach of an essential contractual obligation occurs, i.e. an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely, our liability is limited to the damage that is foreseeable at the time the contract is concluded and typical for the contract.
(3) Otherwise, liability for slight negligence is excluded.
(4) Since TRACER only provides information (§ 2), losses from purchases and sales of crypto assets that you made based on your own decisions are not typical contractual damage within the meaning of paragraph 2. Paragraph 1 remains unaffected.
(5) The above limitations also apply in favour of our legal representatives, employees and vicarious agents.
§ 12 Right of withdrawal for consumers
For paid plans, consumers have a right of withdrawal subject to the following conditions:
Cancellation Policy
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (Elias Schulte-Einhaus, Tracer, Annenstraße 33, 20359 Hamburg, Germany, Email: service@usetracer.app) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this, but this is not mandatory.
You can also fill in the model withdrawal form or any other clear statement electronically on our website and submit it: usetracer.app/widerrufen
If you make use of this option, we will send you a confirmation of receipt of such a withdrawal without delay (e.g. by email).
To meet the withdrawal deadline, it is sufficient that you send the notice of exercise of your right of withdrawal before the withdrawal period expires.
Consequences of cancellation
If you withdraw from this contract, we must refund all payments we have received from you without undue delay and no later than fourteen days from the day on which we receive your notice of withdrawal from this contract. For this refund we will use the same means of payment you used for the original transaction, unless you have expressly agreed otherwise; in no case will you be charged any fees for this refund.
If you have requested that the services begin during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of services already provided up to the time you inform us of your exercise of the right of cancellation regarding this contract, compared with the total scope of the services provided for in the contract.

§ 14 Changes to these terms
(1) We may amend these terms if there is a factual reason, for example a change in the legal situation, case law or our service offering. Changes affecting the relationship between performance and consideration are not made through this route.
(2) We notify you of changes in text form at least six weeks before they take effect. They only take effect if you agree to them. If you do not agree, the contract continues on the previous terms; either party may then terminate it under § 7.
§ 15 Dispute resolution and final provisions
(1) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
